Karan Parcha vs State of NCT of Delhi

The accused/applicant seeks regular bail in case FIR No. 727/2022 of PS Vijay Vihar for offence under Section 376/506 IPC and Section 66/67 of Information and Technology Act.

Broadly speaking, the allegation against the accused/applicant is that he raped the prosecutrix, taking advantage of their friendly relations and thereafter, clicked her naked pictures and videos, on the basis whereof, he started blackmailing her. Not only this, the accused/applicant even uploaded those objectionable pictures of prosecutrix on social media.

Learned APP for State, assisted by IO/SI Rajesh Kumar, accepts notice and at the very outset submits that the application deserves to be dismissed solely on the ground that the accused/applicant concealed having earlier filed in this Court and withdrawn bail application bearing No. 3507/2024. On this aspect, learned counsel for accused/applicant expresses ignorance, but also submits that on behalf of accused/applicant, few interim bail applications also had been filed, but the same have not been disclosed in the present application.

At this stage, one of the Law Researchers of this Court has located and produced before me the record extracted from website of this Court, as per which the accused/applicant filed as many as five bail applications including the present one. Those applications and fate thereof have been concealed by the accused/applicant.

Since the accused/applicant has concealed about the previous bail applications, the present application and the accompanying application are dismissed.
