Heard the parties.
Petitioner has been made accused in connection with Ichagarh P.S. Case No. 79 of 2023 for the offences registered under sections 20((b) (ii) (C), 25 and 29 of N.D.P.S. Act, pending in the court of learned Principal District and Sessions Judge, Seraikella.
During the intervening period of 12 / 13.10.2023, Ichagarh Police on the basis of confidential information, intercepted a trailor bearing registration no. UP 25CT 3786. On seeing the police party, three persons started fleeing away. On chase, petitioner and co-accused Wahid Khan were apprehended and one of the co-accused managed to escape. On search, 810 kgs. of cannabis were recovered from the vehicle.
It was submitted that the petitioner was not arrested while sitting in the vehicle. Therefore, it cannot be said that the cannabis was recovered from the possession of the petitioner.
Specific case of the prosecution is that the petitioner on seeing the police party, started fleeing away from the vehicle and he was apprehended on chase. It also appears that commercial quantity of cannabis was recovered from the possession of the petitioner.
Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail stands rejected.
