Judgment
Tarlok Singh Chauhan, J
The case is taken up for hearing through Video Conferencing due to pandemic COVID-19. The petitioners claim to have got married against the
wishes of their respective parents. They have approached this Court to protect their life and liberty from private respondents. The prayer is based
upon the provisions of Article 21 of the Constitution of India and, therefore, deserves immediate attention of the Police Department to ensure that the
couple is not unduly harassed by anyone including their respective parents.
Accordingly, we direct the Superintendent of Police, Kangra at Dharamshala, to take appropriate steps in this regard, which are consistent with the
safety of the petitioners. These directions are issued on the basis of judgment rendered by the Hon’ble Supreme Court in Lata Singh Versus State
of U.P., (2006) 5 SCC 475. The petitioners are at liberty to represent their case to the aforesaid authority, stating therein their apprehensions, so that
effective steps are taken.
With these directions, the instant petition is disposed of without expressing any opinion on the validity of the marriage. Pending application(s), if any,
shall also stand disposed of.
