Prayer in this petition is for issuance of a directions to the official respondents to look into the grievance of the petitioner wherein he has submitted a representation to take action against respondent No.4.
Counsel for the petitioner has submitted that the wife of the petitioner was working as a Dietician in a Government Hospital at Kurukshetra whereas the respondent No.4 was also working as Chief Medical Officer (CMO) and he was sending vulgar WhatsApp messages to the petitioner, which has resulted into his matrimonial discord.
Though, a reply has been filed on behalf of respondent No.4 along with certain documents like divorce petition filed by Reena Rani, wife of the petitioner as well as the affidavit of Reena Rani is attached with the reply filed by respondent No.4, which suggest that he was having some influence over the matrimonial life of the petitioner.
Reply by way of affidavit of the Deputy Superintendent of Police, Pehowa, District Kurukshetra, is also on record and as per the reply, after going through the contents of the complaint given by the petitioner and on verification, offence under Sections 500 and 501 IPC are made out and since the offencesd were non-cognizable, a DDR No.13 was registered on 24.01.2021 and a copy was given to the petitioner.
In view of the above, counsel for the petitioner submits that he may be permitted to withdraw this petition with liberty to the petitioner to avail his alternative remedy in accordance with law.
Dismissed as withdrawn, with liberty aforesaid.
