Karam Singh vs Director, Rural Development and Panchayat and Others

Kanwaljit Singh Ahluwalia, J.—In the present writ petition, order (Annexure P-8) dated 3rd June, 2010 has been assailed, whereby the complaint made by the Petitioner against Respondent No. 3-Sarpanch of the village has been dismissed.

It was alleged by the Petitioner-complainant that Respondent No. 3-Sarpanch has allotted plots to the Bazigar community out of the land belonging to the Gram Panchayat. The allegations were enquired into and it came into light that the Bazigar community had constructed their houses on the Panchayat land falling within Khasra Nos. 495, 496, 499 and 500, and there were about 60-70 houses of the Bazigar community. It was further stated that the land was given to the Bazigar community in the year 1955, i.e. before the present Sarpanch took-over the charge of his office. The land was given to the Bazigar community after a resolution to this effect was passed by the Gram Panchayat. Furthermore, another resolution was passed on 30th September, 2006 that the land already in possession of the Bazigar community be allotted to them as per the policy of the Government. It was further case of the Sarpanch that this resolution was passed in the earlier term.

The Director, Rural Development and Panchayat, Punjab examined the allegations and has rightly held no merit in the same. The impugned order (Annexure P-8) is just and legal. Hence, no interference is warranted in the present writ petition and the same is hereby dismissed.
