It has been stated on behalf of the respondent/complainant that the matter has been reconciled between the parties.
Learned counsel for the petitioner has produced the receipt dated 30.09.2026, issued by Member Secretary, H.P. Legal Services Authority, Kasumpti, Shimla, regarding the deposit of ₹11,250/- being the 7.5% of the cheque amount of ₹1,50,000/-, which is taken on record.
Learned counsel for the respondent/complainant, under instructions, submits that the matter has been reconciled between the parties and he has instructions not to press the complaint.
In view of this statement, the present revision is allowed and the judgment of conviction and order of sentence dated 14.03.2024, passed by learned Additional Chief Judicial Magistrate, Court No.II, Shimla, District Shimla, H.P. in Case (Registration) No. 584 of 2020, titled Ramesh Kumar Vs. Karam Chand as affirmed by learned Additional Sessions Judge-II, Shimla, District Shimla, H.P. in Case (Registration) No. 6 of 2025 dated 05.07.2025, titled Karam Chand Vs. Ramesh Kumar are ordered to be set aside and the complaint is dismissed as not pressed.
Learned counsel for the parties submit, under instructions, that no amount has been deposited before the learned Trial Court and the learned Appellate Court and further submit that whole amount has been paid by the petitioner/accused to the respondent, therefore, no order is required to be passed regarding release of the amount.
The petitioner is stated to be in judicial custody and he is presently lodged in Model Central Jail, Kanda, District Shimla. He is ordered to be released forthwith, if not required in any other case. Release warrants be prepared accordingly and the same be sent to the Superintendent, Model Central Jail, Kanda, District Shimla through FASTER forthwith for necessary compliance.
In view of the above, the present revision is disposed of, so also the pending miscellaneous application(s), if any.
