Judgment
Kurian Joseph, C.J.—This writ petition is filed with the following prayer:
(i) That the service rendered by the applicant in Distt. Bilaspur and Kinnaur, be taken into account while fixing his seniority in Distt. Hamirpur and the applicant be further accorded all the benefits which he would be entitled to after re-fixation of seniority.
In the reply, in the preliminary objection, it is stated as follows:
The applicant has not exhausted all the channel available to him prior to present OA before the Hon''ble H.P. Administrative Tribunal except representation made too late i.e. on 20.5.1999. Without awaiting the reply of the representation, he has filed the present O.A. The services of Deputy Commissioner Office employees in HP upto the level of Sr. Assistants are of District cadre as per Revenue Department of H.P. notification No. 2-60/72-Rev.1 dated 18.8.2979 and the employees can be transferred in subordinate offices of the concerned district only. In case any employee wants to get himself transferred from one District to another Distt., he can only be transferred on his own request by loosing his seniority and he will not claim of his previous service of that District from where he is transferred. He will get seniority in the new District from the date of his joining as per service conditions laid down in the R and P Rules and transfer orders issued by the Divisional Commissioner, H.P. Shimla vide office order No. 2-1/25/69 -Commr. Dated 14.3.1975. Therefore, the OA of the applicant deserves to be dismissed with cost.
In case the petitioner has still any dispute either with regard to the above submissions or the detailed submissions, he may approach the first respondent, in which case the first respondent will duly consider the matter, with notice to the petitioner and appropriate action in the matter shall be taken within another four months, from the date of production of a copy of this judgment by the petitioner.
The writ petition is disposed of, so also the pending applications, if any.
