Kapil Kumar vs State of U.P.and Others

Vineet Saran, J.—Heard learned Counsel for the petitioner as well as learned Standing Counsel.

The grievance of the petitioner is that after the death of his brother, who was working as Class III employee in the Rajkiya Raja Inter College, Rampur, the petitioner is entitled to appointment under the Dying in Harness Rules, 1974 as he was dependent of his brother. Learned Counsel for the the petitioner has placed reliance on the Government Order dated 12th October, 2002 and prays that he is entitled to such appointment. It is stated by the learned Counsel for the petitioner that with regard to such grievance he has filed representations before the respondents, which are still pending.

Under such circumstances, it is directed that in case if the petitioner files a fresh comprehensive representation before Respondent No. 3, the Joint Director of Education, XIIth Region, Moradabad, within a month from today alongwith a certified copy of this order, the same shall be considered and decided by the said respondent in accordance with law expeditiously, preferably within three months from the date of filing of the representation.

With these observations, this writ petition is finally disposed of.
