Judgment
Narendra Kumar Jain-I, J.—The present writ petition is directed against the impugned order dated 26.07.2011 passed by the Resident Engineer, Division-V, Rajasthan Housing Board, Jaipur, whereby 2% of security amount of Petitioner has been forfeited and Petitioner has been directed to deposit a sum of Rs. 6,63,389.00
Learned Counsel for Petitioner initially argued the matter, but during the course of arguments, he has submitted that he may be allowed to withdraw this writ petition with liberty to file a representation before the higher authorities of the Rajasthan Housing Board i.e. Chairman and till then, Respondents may be restrained from recovering the amount in question.
Prayer is allowed.
The writ petition is, accordingly, allowed to be withdrawn with liberty to file a representation before the Chairman, Rajasthan Housing Board, Jaipur against the impugned order dated 26.07.2011. In case, such a representation is filed within a period of 15 days, then the same will be considered and decided, sympathetically, in accordance with law, as early as possible, but not later than a period of one month from the date of receipt thereof. Till then, Respondent No. 2- Resident Engineer, Division-V, Rajasthan Housing Board will not insist upon the Petitioner to make the payment of disputed amount.
The writ petition as well as stay application, both, is disposed off, as mentioned above.
