Judgment
THIS revision petition is filed against the concurrent finding of the District Forum as well as the State Commission, Uttar Pradesh.
THE dispute involved in this case is that the respondent claimed for refund of the amount deposited with the petitioner as the petitioner did not supply any LPG gas connection and the gas cylinders as was required to be done under the contract for which the respondents made the required deposits. THE only justification given by the petitioner was that the respondents have not been able to build a godown for storage of LPG cylinders. If that was so the petitioner had no reason to hold on to the funds of the respondent who had been asking for it. Notwithstanding all this, for the non-supply of cylinders the District Forum and the State Commission have rightly ordered refund of the money received by the petitioner for the services which he has not rendered, without any interest. We do not find any substance in this revision petition and no ground is made out for us to interfere with the concurrent findings of the Fora below. THE revision petition is accordingly dismissed and the interim order dated 21.5.2001 stands vacated. Revision Petition dismissed.
