Kanwar Singh vs State of Himachal Pradesh

This review petition has been filed by Shri Kanwar Singh, Petitioner against our order dated 2-12-1991 passed in Review Petition No. 11/89 (Nautor) In the order, which is sought to be reviewed, we had ordered the cancellation of nautor land comprised in Khasra No 41/1, situated in Chak Karani, Tehsil Theog, District Shimla, which had been made in favour of Shri Kanwar Singh, Petitioner by our learned predecessor vide his order dated 30-3-1981. The main ground for cancellation of grant was that the provisions of Forest Conservation Act, 1980 appeared to have been escaped the notice of our learned predecessor. Under the provisions of the Act ibid, prior permission of the Central Government is mandatory before the forest land is transferred for any use other than forest.

We have heard the Petitioner and the learned District Attorney (Revenue), who appeared on behalf of the State. No new point has been raised by the Petitioner in his review petition As such, we find no reason to review our order dated 2-12-1991. Accordingly, the review petition is dismissed.
