Judgment
Challenging the orders at Exhibits P1, P2 and P3, the
petitioner filed statutory appeals at Exhibits P8, P9 and P10; which
are accompanied by Exhibits P11 to P13 stay applications, before the
Deputy Commissioner (Appeals), Ernakulam. The appeals and the
stay petitions are pending before the said authority.
While admitting the writ petition, this Court stayed the
proceedings for enforcement of the bank guarantee furnished by the
petitioner. Now that appeals are pending against the impugned
orders at Exhibits P1, P2 and P3, "The Deputy Commissioner
(Appeals), Ernakulam" is suo motu impleaded as the additional 4th
respondent in the writ petition. Government Pleader appears for the
additional 4th respondent.
In the above circumstances, it is directed that the
appellate authority, the additional 4th respondent herein, shall
consider and dispose of Exhibits P8 to P10 appeals as expeditiously
as possible, at any rate, within a period of four months from the date
of receipt of a certified copy of this judgment. The interim order
passed by this Court on 13.03.2017 and extended on 24.03.2017
shall continue till the appeals are disposed of.
The writ petition is disposed of as indicated above.
