Kanpur Development Authority, Kanpur, the Petitioner herein has approached this Commission by filing this Revision Petition under Section 58(1)(b) of the Consumer Protection Act, 2019 against the Order dated 14.02.2023 passed by the State Consumer Disputes Redressal Commission, U.P., Lucknow (hereinafter referred to as ‘the State Commission’) whereby the following effective Order has been passed:

“Since this appeal is being personally looked into by Mr.Shatroghna Vaish, Secretary, Kanpur Development Authority, therefore, the expected decision and necessary action is required to be done by him according to the law. Accordingly, on his request, this appeal is ordered to be listed after 01 month before this Bench. A detailed action taken report in the form of Affidavit must be submitted//made available before this court.

The present Appeal be listed for 24.4.2023 for hearing before this Bench.”

I have heard Mr. Abhishek Chaudhary, learned Counsel appearing for the Petitioner and perused the Impugned Order dated 14.02.2023 as also Memo of Revision and documents filed along with.

The learned Counsel appearing for the Petitioner submitted that all the Orders which have been passed by the State Commission are being complied with and there is no requirement for the State Commission to direct the detailed action taken report in the form of Affidavit must be submitted/made available before it.  The Order does not suffer from any irregularity or illegality for the simple reason is that the Appeal has been fixed for hearing on 24.04.2023.  The Appeal is of the year 2000 and if the State Commission has undertaken to monitor the Matter it cannot be said acted illegally.  I do not find any ground to interfere in the Impugned Order dated 14.02.2023 passed by the State Commission.  The Revision Petition is accordingly dismissed.
