Judgment
Dinesh Kumar Singh, J
In compliance of the Order dated 19.02.2024, Sri Harikrishnan M, S/o Chenthamarakshan T, Manager and Authorised Signatory of M/s ICICI Bank Ltd, 3rd floor, Emgee Square, M G Road, Ernakulam, is present in the Court. He has filed a counter affidavit in response to the notice issued to him. The averments made in the counter affidavit are totally unsatisfactory to the misconduct, prima facie, he has committed while making false statements on oath and not disclosing the relevant document regarding interim injunction granted by the trial Court in O.S. No.782/2022.
As the judgment dated 17.10.2023 under review was an ex parte judgment believing in the averments made in the writ petition, the judgment dated 17.10.2023 is recalled.
Post the writ petition for further hearing and taking appropriate course of action against Sri Harikrishnan M, S/o Chenthamarakshan T, Manager and Authorised Signatory of M/s ICICI Bank Ltd. He is at liberty to file a better affidavit if he is so advised.
