The petitioner seeks that the respondent - University be directed to correct Exts.P2 and P3 marklists, by adding his eligible internal assessment marks, within a time frame to be fixed by this Court.
However, Sri.Thomas Abraham – learned Standing Counsel for the University, responded to the afore submissions of the petitioner, as made by his learned counsel – Sri.M.R.Sabu, saying that no internal assessment marks, except for attendance, had been forwarded to his client by the “C.S.I. Institute of Legal Studies” - of which the 4th respondent is the Principal. He submitted, therefore, that if the Principal forwards the relevant internal assessment marks to the University, necessary action can be taken to correct Exts.P2 and P3 accordingly.
The record reveals that even though the 4th respondent has been validly served summons through E.Mail by the petitioner, he has chosen not to be present personally or to be represented through counsel.
Taking note of the afore submissions and in particular that of Sri.Thomas Abraham, I allow this writ petition with the following directions:
(a) The 4th respondent – Principal of the College will forward the internal assessment marks to the University within a period of one week from the date on which this judgment is produced before him by the petitioner. If there is no change in the internal assessment marks earlier forwarded to the University, the Principal will explain so, including whether the petitioner had taken part in the internal assessment process.
(b) On the 4th respondent making available the marks/response as afore, the University will hear the petitioner, as also the said respondent, and take a decision on the correction of Exts.P2 and P3, if so warranted, within a period of one month thereafter.
