This anticipatory bail application has been filed by the petitioner apprehending his arrest in connection with FIR No.171/2023 registered at Police Station Jawar Mines, District Salumbar for the offences under Sections 306 and 120-B of the IPC.

Heard learned counsel for the petitioner and learned Public Prosecutor and perused the contents of the FIR. This Court vide order dated 05.02.2024 directed the learned Public Prosecutor to keep the case dairy ready for a perusal of this Court. In compliance of this court’s order dated 05.02.2024 learned Public Prosecutor has made available the case diary.

From the perusal of the case diary, this court prima facie finds that the deceased Shanti Lal committed suicide on 10.11.2023 by hanging himself. The deceased Shanti Lal left behind a suicide note wherein, he has named the petitioner as the person who was allegedly having illicit relations with his wife.

Having carefully perused the case diary, this court prima facie finds that there is nothing on record to indicate the petitioner’s involvement in instigating or abetting the deceased to commit suicide. This court also prima facie finds that the petitioner, in compliance of this Court’s order dated 05.02.2024 has already joined the investigation and therefore, extreme interrogation of the petitioner is not required in the present case.

Accordingly, the present anticipatory bail application is allowed and it is directed that in the event of arrest of petitioner- Kanhaiyaa Lal S/o Shankar Lal, in connection with FIR No.171/2023 registered at Police Station Jawar Mines, District Salumber, the petitioner shall be released on bail; provided he furnishes a personal bond in the sum of Rs.50,000/- each along with two sureties of Rs.25,000/- each to the satisfaction of the concerned Investigating Officer/S.H.O. on the following conditions :-

(i). that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii). that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and

(iii). that the petitioner shall not leave India without previous permission of the court.
