Judgment
NAMIT KUMAR, J. (ORAL)
The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing the respondents to grant compassionate appointment and/or ex-gratia amount on account of death of her husband Ajay Kumar, who was working as Lower Division Clerk-cum-Cashier with the respondents-PSPCL, as per policy of the Government of Punjab and the respondents-PSPCL.
On 16.08.2023, the following order was passed:-
“Learned counsel for respondent No. 1 and 2 is directed to file an affidavit with regard to instructions/ Guidelines dated 19.09.2012 (P-10), wherein it has specifically been mentioned that in case where the claimant's dependents are more than one, the appointing Authority must refer the matter to the District Magistrate for determining the real dependent for compassionate appointment.
Learned counsel for respondent Nos. 1 and 2 submits that till today the matter has not been forwarded to the District Magistrate and she seeks time to file an affidavit. Adjourned to 19.09.2023.”
In pursuance to the said order, short reply on behalf of respondents No.1 and 2 has been filed, wherein it has been stated as under:-
“xxx xxx xxx xxx xxx 10. That it is also important to mention here that the on the instructions of this Hon'ble Court vide order dated 16.08.2023, the respondent No. 1 & 2 have forwarded the matter to the District Magistrate for determining the real dependent for compassionate appointment, with regard to the instructions/guidelines dated 19.09.2012. Copy of order dated 16.08.2023 and affidavit dated 14.09.2023 is annexed herewith as Annexure R-1 & R-2.
11.That the office of the District Magistrate passed an order dated 19.03.2024, wherein stating that since the respondent no 3 was born in 1951, therefore she was not eligible for any appointment. Copy of order dated 19.03.2024 is annexed herewith as Annexure R- 2.
12.That thereafter in a meeting held by the respondent no. 1 & 2 on 14.08.2024 it was decided that the petitioner would be awarded an amount of Rs. 2,00,000/- on account of ex-gratia grant to the petitioner on the death of her husband. The same was paid to the petitioner vide a cheque vide cheque No. 652652 dated 02.09.2024. Copy of letter dated 14.08.2024 and Cheque dated 02.09.2024 is annexed herewith as Annexure R-3& R-4 respectively.
13.That now it has been intimated by the office of S.E. Circle Jalandhar that the complete case by the office of Chief Engineer/North Jalandhar has been forwarded to head office Patiala vide their Memo No. 5697 dated 26.07.2024, for further considerations on the claims of the petitioner. xxx xxx xxx xxx xxx”
Learned counsel for the petitioner submits that the petitioner would be satisfied if directions are issued to the respondents to finalise the claim of the petitioner in a time bound manner.
Learned counsel for the respondents has no objection to the innocuous prayer made by learned counsel for the petitioner.
Consequently, the present petition is disposed of with a direction to respondent No.1 to finalise the claim of the petitioner for compassionate appointment within a period of three months from the date of receipt of certified copy of this order.
