Judgment

This matter is taken up through hybrid arrangement.
The Petitioner, by filing this Writ Petition, has made the following prayer:-
“The petitioner therefore prays that Your Lordship' would graciously be pleased to admit the writ application, call for the records, issue notice to the Opp. Parties and after hearing both the parties quash/set aside the eviction proceedings initiated by the Tahasildar, Barbil, Under Annexure-2 by issuing Form "Ka" by issuing writ/writs in the nature of Certiorari/Mandamus in the greater interest of justice.
And further be please to confirm the decision taken by the Executive Officer, Barbil Municipality, under Annexure-1, as per the Odisha Land Rights To Slum Dwellers Act, 2017, in the greater inter interest of justice.
And pass any other order(s), direction (s) as this Hon'ble Court may deem fit and proper.”

Considering the submissions made by the learned counsel for the Petitioner and on going through the averments made in this Writ Petition, this Writ Petition stands disposed of directing the Petitioner to file the reply
to the “KA” form issued by the Tahasildar, Barbil within a period of 7 days. In such event, the Tahasildar, Barbil shall consider the merit of the case and, accordingly, pass appropriate order in accordance with law within a period of two weeks from the date of presentation of this order.
It is further directed that till the Tahasildar, Barbil/Opposite Party No.5 passes any final order, no coercive action shall be taken against the Petitioner.
Accordingly, the Writ Petition stands disposed of.
