In wake of second surge in the COVID-19 cases, abundant caution is being maintained, while hearing the matters in Court, for the safety of all concerned.
The investigating officer present in person alongwith the learned Public Prosecutor before this Court submits that since the jurisdiction of the case has been found to be made out in the jurisdiction of another police station, therefore, the matter is being referred to the Police Commissionerate, Jodhpur for appropriate action.
Learned counsel for the petitioner however, submits that the petitioner may be given liberty to approach the Commissioner of Police, Commissionerate, Jodhpur alongwith a representation raising the issues of territorial jurisdiction as well as merits, and the same may be considered by the authority concerned.
In view of the above, the present petition is disposed of, while directing the petitioner to submit a representation before the Commissioner of Police, Commissionerate, Jodhpur within a period of three days from today, who shall consider such representation in regard to the issues of the territorial jurisdiction as well as on merits, while also taking into consideration the report being submitted by the concerned investigating officer, and thereafter, shall take the final decision regarding the future proceedings, strictly in accordance with law. All pending applications also stand disposed of.
