This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard Mr. Satyakanta Routray, learned counsel for the petitioner.

The present writ petition has been filed for a direction to the opposite parties for repayment of outstanding loan amount through EMI Scheme.

In this regard, the petitioner has filed a representation vide Annexure-7 before the Branch Manager, State Bank of India, Phulnakhara - Opp. Party No.2. The said representation is stated to be still pending.

Regard being had to the facts and submissions and the nature of relief sought for, the writ petition is disposed of, directing the Branch Manager, State Bank of India, Phulnakhara Branch, Phulnakhara- Opp. Party No.2, to dispose of the representation of the petitioner vide Annexure-7 in accordance with the Policy of the Bank, by passing a reasoned order, within a period of three months from the date of receipt of a certified copy of this Order.

It is made clear that, if the petitioner shows her readiness and willingness to settle the loan amount through EMI and such proposal is beneficial to the bank, the said proposal of the petitioner may be accepted on disposal of the representation vide Annexure-7 and the tractor seized, may be released in favour of the petitioner.

The petitioner is directed to supply a copy of the writ petition containing all the annexures along with a certified copy of this Order to the Opp. Party No.2 for convenience & reference to Annexure- 7.

The writ petition is accordingly disposed of.

Urgent certified copy of this Order be granted as per rules.
