Judgment
Chatra Ram, J.—This bail application u/s 439 Cr.P.C. has been filed on behalf of petitioners against whom investigation is pending for the offences under sections 323 and 307 I.P.C. in FIR No.78/05 P.S.Ramgarh Shethan District Sikar.
Learned counsel for the petitioners states that in this case the petitioners are not named in the FIR and the alleged incident is of 9.11.2005 whereas the eye witnesses Bhagwan Singh, Dalip Singh and Bhanwar Singh have been examined on 11.1.2006. This case has been made out because, of enmity after a thorough planning. Therefore, the petitioners may be released on bail.
Learned P.P. opposed the bail application.
Without expressing any opinion on the merits of the case but taking into consideration the submissions made at the bar, the materials on record and all other facts and circumstances of the case, I deem it just and proper to enlarge the petitioners on bail.
In the result, this bail application is allowed and it is directed that petitioners Kan Singh, Bheru Singh and Ghisu Singh be released on bail on each of them furnishing a personal bond in the sum of Rs.30,000/- together with two sureties in the amount of Rs. 15,000/- each, to the satisfaction of the trial court for their appearance before that Court on each and every date of hearing until conclusion of trial.
