The present MCC has been filed seeking restoration of FA No. 40/2015, which was dismissed for want of prosecution by order of this Court dated 10.09.2026.

Though the matter is listed for orders on defaults as per the Registry note, the aforesaid appeal has already been restored vide order dated 16.09.2026. Therefore, no further order is required in the matter of restoration of the appeal.

Learned counsel for the applicant submits that he does not want to press the present MCC and seeks permission of this Court to withdraw the same.

Accordingly, the present MCC is dismissed as withdrawn.
