Judgment
Shashi Kant Gupta, J.—On 23.12.2009 the case was listed but due to strike of the lawyers, the case could not be taken up and on a mention being made by the learned counsel for the revisionist, the case was directed to be listed today i.e.24.12.09 as unlisted with a direction to him to inform the learned counsel for the respondent about the order passed on that date in writing.
Case called out. Learned counsel for the revisionist is present. None is present on behalf of the respondents.Today also the lawyers are reported to be on strike.
Learned counsel for the revisionist states that in compliance of the above order dated 23.12.09 the learned counsel for the respondent was duly informed by means of the notice dated 23.12.09, a copy of which has been produced before the court and the same is kept on record, but he is not present in court.
In view of the facts and circumstances of the case as well as the urgency involved in the matter, in the interest of justice, it is directed that the revisionist shall not be evicted from the property in dispute i.e. house no. 235, Arya Nagar, Muzaffar Nagar till 8.1.2010.
List the matter on 8.1.2010? before the regular court. This case? may not be treated as tied up? or? part heard? with this Bench.
