Judgment
By this application under section 482 of the Code of Criminal Procedure, 1973, the applicants herein-original accused persons, seek to invoke the inherent powers of this Court praying for quashing of the first information report being C.R.No.I-70 of 2016 registered with the Khambat City Police Station, Anand for the offence punishable under sections 406, 420, 465, 467, 468, 471 and 120(B) of the Indian Penal Code.
The Investigating Officer is present today in the Court. He points out that he has received the F.S.L report, i.e., the report of the handwriting expert. The document in question has been found to be false prima facie. The signatures of one Chimanbhai Motibhai Patel and Gordhanbhai Hirabhai Vankar are found to be forged on the document, on which, reliance is being placed by the applicants herein.
The investigation is in progress. A prima facie case could be said to have been made out. I am not inclined to entertain this application at this stage as the picture is quite hazy and also considering the report of the F.S.L.
Let the investigation proceed further in accordance with law at the earliest.
With the above, this application is rejected. Rule is discharged. The ad-interim order, earlier granted, stands vacated.
