The instant petition has been filed for the grant of following reliefs:

i) That the respondent No.1 Bank may be directed to release the amount lying in the account of late Sh. Khem Chand (brother of the petitioner) to the petitioner with uptodate interest.

ii) That unless and until the succession certificate issued in favour of the petitioner is set aside in accordance with law the respondent No.2 may be held to be not entitled to receive the amount in the question."

Learned counsel for the petitioner as also learned counsel for 2nd respondent jointly state that the matter in issue has been compromised by executing a compromise deed that has already been handed over to respondent No.1­Bank whereby 2nd respondent has expressly given up his share and has agreed to the petitioner's entitlement to the amount in question on the basis of compromise.

Accordingly, the present writ petition is disposed of with the direction to respondent No.1­Bank to release the amount lying in the account of late Sh. Khem Chand to the account of the petitioner alongwith uptodate interest as expeditiously as possible and in no event later than 4th December, 2020.

Pending application(s), if any, also stands disposed of.
