Judgment
Ajay Mohan Goel, J
By way of the present writ petition, the petitioner has prayed for following reliefs:-
(i) that respondent No.2 Deputy Director elementary education/competent authority may be directed to count the past ad-hoc service of petitioner, since 1990 till 01.04.2001 for the purpose of seniority, pay fixation and increment and being qualifying service & salary arrears for the purpose of pension with all consequential benefits, in the light of law laid down in CWP(T) No.7712 of 2008 & CWP(T) No.8872 of 2008 Paras Ram versus State of H.P. & Ors. & LPA 36 of 2010 Sita Ram versus State of H.P. & Ors. dated 19.05.2009, 29.04.2010 and 15.07.2010.
(ii) that respondents may be directed to pay the penal interest at the rate of 12% on account of delayed payments. Any other orders which this Hon’ble Court may deem fit & proper may kindly be passed.
Despite opportunity having been granted, reply to the petition, not filed.
In light of the prayer made in the writ petition, learned counsel for the petitioner submits that interest of justice would be served, in case, respondents are directed to decide the representation that has already been filed by the petitioner.
This Court is of the considered view that let the petitioner file a fresh representation within two weeks from today and thereafter the respondents may decide the same within six weeks as from the date of receipt thereof.
Learned Additional Advocate General submits that needful will be done, in case, fresh representation is filed by the petitioner.
This petition is disposed of, with the direction, that let the petitioner file fresh representation with regard to issue raised in the petition within two weeks from today and as from the date of receipt thereof, the same be decided by the competent authority in the light of the averments made therein as well as the judgment referred thereto.
