Petitioner Kamalpreet Kaur Virk filed present petition under Sections 10 & 12 of Contempt of Courts Act, 1971 with the prayer to initiate contempt proceedings for willful and deliberate disobedience of order dated 27.05.2025 (Annexure P-4) passed in TA-556-2025 in view of order dated 27.05.2025 (Annexure P-3 passed in connected TA No.1559 of 2024) and order dated 22.07.2025 (Annexure P-7) passed by this Court in TA No.556 of 2025 and in CM No.12652-CII of 2025 whereby the respondent was directed to file an affidavit disclosing the detail of the properties owned by him and his parents.

I have heard the arguments advanced by learned counsel representing the petitioner as well as learned senior counsel for the respondent and have gone through the documents annexed with the present petition with their able assistance. As per the facts, Kamalpreet Kaur Virk filed TA No.1559 of 2024 regarding transfer of petition under Section 13 of Hindu Marriage Act, 1955 titled “Guntas Singh Randhawa vs. Kamalpreet Kaur Virk” and another TA No.556 of 2025 for transfer of Civil Suit No.537 of 2025 titled “Guntas Singh Randhawa vs. Kamalpreet Kaur Virk and others”. Both the transfer applications were taken up together. During the pendency of aforesaid transfer applications, in TA No.1559 of 2024 titled “Kamalpreet Kaur Virk vs. Guntas Singh Randhawa” the Co-ordinate Bench considered the scope of amicable settlement regarding dissolution of marriage by mutual consent and both the parties were directed to file their respective affidavits with regards to the detail of properties as detailed in order dated 27.05.2025 in TA No.1559 of 2024 (Annexure P-3) and the connected TA No.556 of 2025 was also adjourned along with the connected transfer application vide order dated 27.05.2025 (Annexure P-4). Later on application was filed by the respondent in TA No.556 of 2025 seeking recall/modification of order dated 27.05.2025 (Annexure P-6) and the said application was dismissed by the Co-ordinate Bench vide order dated 22.07.2025 (Annexure P-7). Finally, both the transfer applications were disposed of by passing common order dated 23.07.2025 (Annexure P-8).

It is matter of record that pertaining to the aforesaid direction for filing of affidavit regarding detail of properties, contempt petition No.2949 of 2026 titled “Kamalpreet Kaur Virk vs. Guntas Singh Randhawa” was filed in TA No.1559 of 2024 and CM No.12653-CII of 2025 which was disposed of vide detailed order dated 03.07.2026 passed by the Co-ordinate Bench.

On same facts, present contempt petition has been filed for non-compliance of order dated 27.05.2025 (Annexure P-4) and order dated 22.07.2025 (Annexure P-7). Firstly, aforesaid transfer applications are already disposed of by passing common order dated 23.07.2025 (Annexure P-8) and secondly, the affidavit was called upon to explore the amicable settlement of matrimonial dispute between the parties which ultimately could not lead to any fruitful conclusion. Therefore, in the light of this, there is no sufficient reason to proceed in the present contempt petition and the same is accordingly dismissed in terms of order dated 03.07.2026 passed in COCP No.2949 of 2026 passed by the Co-ordinate Bench.

Pending miscellaneous application(s), if any, stand disposed of accordingly as well.
