T.P.S. Mann, J.—Prayer made in the petition is for grant of regular bail to the petitioner during the pendency of the trial of the case.

As per the prosecution, 1700 intoxicating tablets were recovered from the petitioner on 3.9.2013 and, accordingly, he was booked for committing the offence u/s 22 of the NDPS Act.

On the last date of hearing, learned counsel for the petitioner, after drawing the attention of this Court to the medical record (Annexure P-3) had submitted that the petitioner is a young man of 30 years of age and found to be HIV+ve. Learned State counsel, however, requested for an adjournment for obtaining instructions.

Learned State counsel has produced the photocopy of the report dated 14.7.2014 issued by the Medical Officer, District Jail Roopnagar, wherein, it is mentioned that the petitioner was sent to Civil Hospital, Ropar and then referred to PGIMER, Chandigarh, where he was diagnosed as HCV+ve and being provided treatment as per record.

Keeping in view the fact that the contraband, said to have been recovered from the petitioner falls within the definition of commercial quantity, no ground is made out for granting the concession of bail to the petitioner. Further, as regards the ill health of the petitioner, he is being provided proper treatment.

The petition is, accordingly, dismissed.
