Petitioner’s primary prayer in this petition concerns grant of pension to her under the Central Civil Services (Pension) Rules 1972. Her case was rejected by the respondents on 29.10.2024 (Annexure P-6). Petitioner’s contention is that her prayer for pensionary benefits under the CCS (Pension)Rules 1972 had been rejected by the respondents illegally.
On being put to notice on 16.12.2024, learned Additional Advocate General during the course of today’s hearing placed on record office instructions dated 03.01.2025 and submitted that petitioner is entitled to pension under the Old Pension Scheme in accordance with the CCS (Pension) Rules 1972. Learned Additional Advocate General further submits that the case of the petitioner is now under process and upon completion of requisite formalities by both the parties, due and admissible pension shall be released to the petitioner.
Learned counsel for the petitioner submits that the petitioner would cooperate with the respondents and complete all necessary formalities at her end within four weeks. Upon petitioner's completion of paperwork at her end, necessary action shall be taken by the respondents within six weeks, thereafter.
The writ petition is disposed of in above terms. Pending miscellaneous application(s), if any, shall also stand disposed of.
