This matter is taken up through hybrid mode.
The Petitioners in this CMP pray for a direction for early disposal of C.S. No. 11 of 2022 pending in the Court of learned Civil Judge (Senior Division), Kamakhyanagar.
It is submitted by learned counsel for the Petitioners that although pleadings are complete and the matter is ready for hearing, but learned trial Court is liberally adjourning the suit on the prayer of the Plaintiff-Opposite Party for which the Defendants-Petitioners are seriously prejudiced. Hence, finding no other alternative, this CMP has been filed.
Considering the submission made by learned counsel for the Petitioners and on perusal of the record, it appears that the matter is being adjourned since 23rd December, 2022 at the instance of the Plaintiff. It is not known as to why repeated applications for adjournment are being entertained by learned trial Court. It appears that the matter has been adjourned at the instance of the Plaintiff on more than ten occasions.
In view of the above, this Court disposes of the CMP with a direction that learned Civil Judge (Senior Division), Kamakhyanagar shall do well to take appropriate steps for early disposal of the suit. No liberal/unnecessary adjournments shall be granted to any of the parties in the suit. Parties are also directed to cooperate with learned trial Court for early disposal of the suit.
Urgent certified copy of this order be granted on proper application.
