Heard on I.A. No.1179/2026, which is second application under Section 430(1) of the Bhartiya Nagarik Suraksha Sanhita, 2023 for temporary suspension of jail sentence and grant of bail filed on behalf of appellant - Ravi Verma on account of death of his mother.
Along with the application, an affidavit has been filed by the appellants. Counsel for the State prays for time to verify the factum of death. Considering the fact that the death of mother of the appellants took place on 13.01.2026 and the rituals are to be performed on 24.01.2026, we are of the considered opinion that the appellants are entitled for temporary suspension of jail sentence. Accordingly, I.A. Nos. 1182/2026 & 1179/2026 stand allowed.
Subject to verification of factum of death by the trial Court today itself, the jail sentence of appellants - Kamal & Ravi Verma shall be temporarily suspended for a period of seven days from today upon furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) each with separate surety of the like amount to the satisfaction of the trial Court. The appellants shall immediately surrender before the Trial Court after expiry of seven days. In case, if the appellants do not surrender before the Court, the trial Court shall be free to take action for arrest of the appellant, in accordance with the law.
Copy of this order be sent to trial Court immediately.
