Judgment

Heard learned Counsel for the applicant, learned AGA and perused the record.
It is contended by the learned Counsel for the applicant that the order of externment has been passed against the applicant but 15 days prior the expiry of aforesaid period, the applicant was apprehended within the area of DistrictAgra. The applicant is in jail since 29.5.2008.
In view of the facts and circumstances of the case and submissions made by the learned Counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Kamal Singh @ Jugunu involved in case Crime No. 330 of 2008 under section 3/10, U.P. Gundas Niwaran Adhiniyam, P.S. Sadar Bazar, District Agra be released on bail on his furnishing a personal bond and two heavy sureties each in the like amount to the satisfaction of the Court concerned with a condition that the applicant shall serve the period of externment in default he shall again taken in custody.
Application Allowed.
