Kamal Singh vs The State of Rajasthan

We have heard learned counsel for the accused appellant as well the learned Public Prosecutor and perused the record. It is not disputed that the case of the present appellant is not distinguishable from that of the co-accused whose sentence has been suspended by this court vide order dated 20.9.2012 in D.B. Cr. Misc. Bail Application (SOS) No. 744 of 2012, Girvar Singh and Ors v/s State of Rajasthan.

In the facts and circumstances of the case, therefore, it is hereby directed that the sentence awarded to the accused appellant Kamal Singh S/o Shri Ram Narayan who is at present lodged at Central Jail, Bikaner pursuant to his conviction by the learned Special Judge, SC/ST (Prevention of Atrocities Act) Cases, Jhunjhunu in Sessions Case No. 54/2001 vide judgment dated 5.3.2012 shall remain suspended during the pendency of this appeal and he shall be released on bail provided he executes a personal bond in the sum of Rs. 50,000/- along with two sureties in the sum of Rs. 25,000/- each, to the satisfaction of the trial court for his appearance before this Court on 29.10.2012 and whenever called upon to do so. It is made clear that he shall be released, if not required in any other case.
