Judgment

This matter is taken up through video conferencing mode.
Heard Mr. Mohanty, learned counsel for the Petitioner.
The Petitioner in this CMP seeks to assail the order dated 24th December, 2020 (Annexure-4) passed by learned Civil Judge (Senior Division),
Second Court, Cuttack in CMA No. 135 of 2020 (arising out of C.S. No. 548 of 2020) in a petition filed under Section 151 C.P.C.
In course of hearing, Mr. Mohanty, learned counsel for the Petitioner prays for withdrawal of CMP seeking liberty to move the learned District
Judge, Cuttack for early disposal of FAO No. 26 of 2021.
In view of such prayer, the CMP is disposed of as withdrawn with an observation that if the Petitioner moves an application stating the grounds
therein for early disposal of FAO No. 26 of 2021 pending before learned District Judge, Cuttack, he shall do well to consider the same in accordance
with law and proceed with the matter accordingly.
As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order
available in the High Court’s website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide
Court’s Notice No.4587, dated 25th March, 2020 as modified by Court’s Notice No.4798, dated 15th April, 2021.
