Affidavit-of-service filed in Court be kept with the record.
Petitioners’ grievance is that constructions are being carried out in two plots, description of which is per disclosure pages 13 and 14 in the writ
petition. Ms. Chowdhury, learned advocate appears on behalf of Howrah Zilla Parishad and hands up report dated 1st March, 2019 of Assistant
Engineer. Contents of the report are reproduced below.
“An inspection was held by undersigned on 27.02.2019 at the site in connection with the writ petition WP No.1834 (W) of 2019, Kalyani Mallick &
Others. The land was identified by the representative of the petitioner. At the time of inspection, it was appeared from the site that no construction
was made at the identified plot. The land was fully vacant. The petitioner has submitted fault petition for unauthorized construction. The petitioner has
presented wrong information to the Hon’ble High Court. The petitioner mis-guided Howrah Zilla Parishad (H.Z.P). They wasted the valuable time
of a responsible Sub-Assistant Engineer of HZP. The present photograph of the land is attached herewith.
It is expected from Hon’ble High Court at Calcutta, that the Court will take proper action for such activity of petitioner.â€
Adjournment is granted for petitioners to be heard as to why exemplary cost should not be imposed upon them for indulging in frivolous activity.
