BY this application, petitioner is seeking recall of order dated 19.12.2014, which is reproduced as under : - "Learned counsel for the petitioner on instructions states that the petitioner is ready and willing to comply with the directions of the foras below so far as it relates to him but he reserves his right to avail of his remedy against respondent M/s Nath Constructions through proprietor Mr.Amitabh Singh by resorting to appropriate proceedings. Liberty granted. Revision petition is dismissed as withdrawn."
LEARNED counsel for the petitioner states that the petitioner has withdrawn the revision petition under the mistaken impression that after getting dues from M/s Nath Constructions, the petitioner was required to execute sale deed in favour of the respondent/complainant. We do not find merit in this plea because the order is clear and it records that the petitioner reserves his right to avail of his remedy against the respondent M/s Nath Constructions through Proprietor Mr.Amitabh Singh by resorting to appropriate proceedings.
IN view of the above, we do not find any reason to recall the order after withdrawal of the revision petition.
