This petition has been filed by the petitioner aggrieved of rejection of his prayer for being released on first 20 days parole.

Submissions have been made that rejection of petitioner’s application referring to the rules of 2021 is not justified as applicable Rules would be the Rules of 1958, which were in force at the time when petitioner was convicted and, therefore, the order impugned be set aside.

Learned AAG made submissions that a Circular dated 30.6.2023 has been issued by the Director General, Prisons, Rajasthan Jaipur, inter alia directing that in cases which are required to govern by Rules of 1958, they be decided in terms of the Rules of 1958, based on which, the case of the petitioner has been sent to the District Collector.

In view of the above fact situation, the petition filed by the petitioner is disposed of. The respondent no.2 is directed to decide the pending application of the petitioner expeditiously preferably within a period of three weeks from the date of this order.
