This matter is taken up through hybrid mode.
Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
The Petitioner was earlier granted bail as per order dated 8th January, 2019 passed by this Court in BLAPL No.340/2018. One of the condition of such bail was that he should appear before the Court below. However, on 27th August, 2019 he was found to be absent for which N.B.W. was issued against him on the strength of which he was arrested again on 13th May, 2023 in connection with Khallikote Excise P.R. Case No.40/2016-17 corresponding to 2(a) C.C. No.7/2016 (N) pending in the Court of learned Addl. Sessions Judge-cum-Special Judge, Khallikote for the alleged commission of the offence under Section 20(b)(ii)(C) of N.D.P.S. Act.
Considering the fact that that this Court has already directed his release on bail considering the merits of the case and the Petitioner defaulted only once in his appearance, I am inclined to take a lenient view. Let the Petitioner be released on bail in the aforesaid case on such terms and conditions as the Court in seisin over the matter may deem fit and proper including the conditions that he shall personally appear before the Court below on each date of posting of the case.
The BLAPL is disposed of.
Urgent certified copy of this order be granted on proper application.
