Judgment
Heard.
Record be called for and list thereafter for admission. Also heard on I.A. No. 6087/2020 an application for suspension of sentence and for grant of bail.
The present revision is arising out of the judgment dated 27-11-2014 passed by Judicial Magistrate Class-I, Jhabua convicting the applicants for an offence u/s 323, 342, 325/149 iof IPC . The judgment of conviction has been affirmed by the appellate court in Criminal Appeal No. 147/2014 decided on 01-09-2020. The applicants have been convicted for an offence u/s 342 of IPC and has been sentenced six months R.I. alongwith a fine of Rs.100/-, u/s 323/149 of IPC and has been sentenced three months RI alongwith a fine of Rs. 100/- and u/s 325/149 of IPC and has been sentenced six months R.I with a fine of Rs.500/- and in case of default of payment of fine further one month R.I .
It is submitted by learned counsel for the applicants that during trial as well as during pendency of the appeal the applicants were released on bail and they did not misuse the liberty granted to them. It is further submitted by him that looking to the period of sentence, the application for suspension of sentence may be allowed.
Considering the averments as made in the application and looking facts and circumstances of the case and looking to the period of custody and the period of sentence, without expressing any opinion on merits of the case, I.A. No. 6087/2020 is allowed and it is directed that the substantive jail sentence of the applicants shall remain suspended and they be released subject to their furnishing a bail bond in the sum of Rs.50,000/-(Rs. Fifty thousand only) each with one solvent surety in the like amount to the satisfaction of the trial Court and they shall appear before the Registry of this Court on 18-12-2020 and on all other subsequent dates as may be given in this behalf.
