R. Banumathi, J.—The Petitioner seeks a Writ of Mandamus directing the first Respondent to transfer the case in Crime Nos. 214 and 261 of 2010 on the file of Watrap Police Station, Virudhunagar District to CBI, as per the representation of the Petitioner, dated 07.11.2010.

The grievance of the Petitioner is that there has been long standing communal enmity between ''Pallan'' community and ''Parayar'' community in W. Pudupatti, Srivilliputhur Taluk, Virudhunagar District and cases have been registered against both the groups. According to the Petitioner, she belonged to ''Hindu Pallan'' community and she has been victimised at the hands of the other group i.e ''Parayar'' community. The Petitioner is one of the accused in the above said cases.

While considering the cases filed under Public Interest Litigation, the Court should deal with those cases with care and caution as held by the Honourable Supreme Court in Neetu v. State of Punjab) reported in 2007(6) MLJ 1177. The Court must not allow its procedure to be misused. In the above decision, the Honourable Supreme Court has cautioned the High Courts against unmindful of entertaining all Public Interest Litigation.

By perusal of the records, we find that the Petitioner herself is one of the accused in the above said crime numbers. We do not find any Public Interest involved in this Writ Petition. The Writ Petition is dismissed giving liberty to the Petitioner to work out her remedy in the manner known to law. Consequently, connected miscellaneous petitions are closed. No costs.
