This application has been filed by the Petitioner to take back the Demand Draft No.161372 dated 23rd January, 2024 drawn on UCO Bank, Bhubaneswar to deposit the same before the Family Court, Bhubaneswar.
Vide order dated 11th January, 2024 passed in I.A. No. 317 of 2023, this Court directed the Petitioner to deposit a sum of Rs.1,50,000/- before the Registrar (Judicial) within a period of fifteen days for consideration of the I.A. for condonation of delay. It was also directed that if the amount is deposited within the stipulated period, the same shall be invested in fixed deposit in any Nationalized Bank for a period of three months, which shall be renewed from time to time until further orders. Pursuant to the direction of this Court, the Petitioner has deposited the aforesaid bank draft, which has already been invested in a fixed deposit scheme.
Mr. Deba Kumar Rath, learned counsel has entered appearance on behalf of Opposite Party.
In course of hearing, Mr. Bose, learned counsel for the Petitioner submits that the amount so deposited in fixed deposit along with accrued interest thereon may be released in favour of Opposite Party.
Hence, it is directed that the amount so deposited pursuant to the direction of this Court dated 11th January, 2024 along with accrued interest thereon shall be released in favour of Opposite Party on proper identification. On receipt of the amount, the Opposite Party shall file an affidavit before learned Judge, Family Court, Bhubaneswar in CRL (Exec.) Case No.25 of 2023 (arising out of CRP No.118 of 2015) pending before learned Judge, Family Court, Bhubaneswar to that effect. The amount so received shall be adjusted towards arrear maintenance amount due to the Opposite Party.
It is submitted by Mr. Rath, learned counsel for Opposite Party that he has filed I.A. No.189 of 2024.

The I.A. is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
