The petitioners approached this Court praying for the following relief:-

"That the petitioners had filed application forms for Haj Pilgrimage with one proposed Shri Faiz Mohd. but due to ill-health he has opted not to travel as a Haji along with the petitioners and now in place of said Mehram the petitioners have proposed new Mehram Mohd. Shafie S/o Jalal-ud-Din the real uncle of the petitioners but the respondents are not going to change the Mehram with the result that the petitioners are not being allowed to perform the Haj pilgrimage although the said Mehram Mohd Shafie has been granted Cover No. 1420 and he is also going to perform the Haj pilgrimage and with the result that the petitioners are being debarred from performing Haj pilgrimage."

A perusal of the aforesaid relief, as sought by the petitioners shows that direction was sought to allow them to perform pilgrimage for Haj - 2007 under Cover No. 1765/5.

While issuing notice on 05.12.2007, this court passed the following order:-

"OWP No. 1041/2007

Notice.

Mr. A. H. Qazi, AAG, accepts notice on behalf of respondent Nos. 1 to 4.

CMP No. 1503/2007

Notice. In the meanwhile, the Executive Officer, Jammu and Kashmir State Haj Committee, Srinagar, shall pass appropriate orders on Communication No. ENT/R/H/07/474 dated 29.11.2007 of Deputy Commissioner, Rajouri.

A Copy of the order shall be sent by FAX to respondent No. 2 at the expense of the petitioners."

Thereafter the matter was never listed. The claim of the writ petitioners in the present petition was for performing Haj in the year 2007. Prima-facie with the passage of time the relief prayed for has been rendered infructuous.

However, as none have appeared for the petitioners, the writ petition is dismissed for non-prosecution.
