Judgment
This second appeal has been preferred against the impugned judgment and decree dated 28.06.2017 passed by learned Additional District Judge, Bemetara, District – Bemetara in Civil Appeal No.16-A/2015.
Heard on IA No.02, which is an application filed under Order XXIII Rule 1 of the CPC seeking permission for withdrawal of the instant appeal.
Learned counsel appearing for the appellant submits that during the pendency of the appeal, the parties have amicably settled their dispute and the appellant no longer wishes to prosecute the matter further and, therefore, seeks permission of this Court to withdraw the present appeal.
In view of the submission made, IA No.2 is allowed and the appellant is permitted to withdraw the present appeal.
Accordingly, the appeal is dismissed as withdrawn.
