Judgment
Ahanthem Bimol Singh, J
[1] Heard Mr. N. Jotendro, learned senior counsel assisted by Mr. Murtaza Ahmed, learned counsel appearing for the petitioner, Mr. Shyam Sharma, learned GA appearing for the respondents No. 1, 2 & 3 and Mr. Kh. Arunkumar Singh, learned counsel appearing for the respondent No. 4.
None appeared for the respondent No. 5 to 12 despite service of notice.
[2] The present petition had been filed with the sole prayer for directing the Assistant Survey & Settlement Officer, Thoubal-II to complete the Revenue Demarcation Case No. 18 of 2020 filed by the present petitioner praying for demarcating his homestead land under Patta No. 159/part (Old) 236/5941 (New), covered by C.S. Dag No. 4399/5681 (A) measuring an area of .0333 Hectare, situated at Village No. 33-Khangabok under Thoubal Tehsil, Thoubal District, Manipur within a stipulated period as provided under Chapter VI Section 53 of the Manipur Land Revenue & Land Reform Acts, 1960.
[3] When the matter is taken up today, Mr. Th. Arunkumar Singh, learned counsel appearing for the respondent No. 4 submitted before this Court that he has got instructions from the respondent No. 4 that he will try his best to complete the demarcation proceedings within a period of 2 (two) months. The learned counsel further submitted that if for any unforeseen reasons the said demarcation cannot be completed within the aforesaid period of 2 (two) months, the respondent No. 4 be given liberty to approach this Court for extension of the time.
[4] Mr. N. Jotendro, learned senior counsel appearing for the petitioner submitted that the present writ petition can be disposed of by issuing directions as submitted by the learned counsel appearing for the respondent No. 4.
[5] After hearing the submissions advanced by the learned counsel appearing for the parties, the present writ petition is disposed of by directing the respondent No. 4, i.e., the Assistant Survey & Settlement Officer, Thoubal-II to dispose of the above mentioned Demarcation Case and to carry out the demarcation of the above land of the petitioner within a period of 2 (two) months from the date of receipt of a copy of this order.
[6] It is also hereby directed that during the proceedings of the said demarcation, the respondent No. 5 to 12 should cooperate with the respondent No. 4. It is also made clear that if the respondent No. 4 cannot complete the demarcation proceedings within the stipulated period of 2 (two) months, he is at liberty to approach this Court seeking for extension of time.
With the aforesaid directions, the present writ petition is disposed of.
