By way of this execution petition, the petitioner is seeking the execution of judgment dated 11.10.2023, passed in CWP No. 6697 of 2023, titled Kaka Ram Vs. HRTC and others, in which the respondents are directed decide the case of the petitioner, in the light of the judgment passed, which find mention in para No.3 of the order.
Learned Counsel appearing for the respondent-Corporation intimates the Court that the case of the petitioner has been rejected on the ground that the Corporation has preferred a Review Petition against the judgment passed in Amar Chand’s case.
This Court is of the considered view that if the Corporation has preferred Review Petition in the judgment passed in Amar Chand’s case then it would have been prudent for the Corporation to await the outcome of the Review petition rather rejecting the representation of the petitioner and forcing him to another round of litigation. Therefore, as prayed for, these execution proceedings are closed, with the direction that a fresh call will be taken in the case of the petitioner, in the light of the judgment dated 11.10.2023, after appropriate orders are passed by the Court in Review Petition, filed in Amar Chand’s case. Pending miscellaneous applications, if any, also stand disposed of
