Judgment
Virendra Vikram Singh, J.—Heard learned counsel for the applicant and the learned AGA.
The present application u/s 482 Cr.P.C. has been moved with the prayer to quash the impugned charge sheet dated 6.6.2013 in Case Crime No. 647 of 2013, under Sections 406, 407, 411, 413, 504, 506 IPC, P.S. Kotwali Lalitpur, District Lalitpur, pending in the court of Additional District Judge(D.A.A.), Lalitpur.
It has been argued that the offence in question relates to a civil transaction whereby even if the prosecution be accepted the machine in question has not been returned, hence no offence is made out against the applicant.
After the investigation charge sheet under Sections 406, 407, 411, 413, 504, 506 IPC has been submitted against the applicant, for which the trial is pending before the Special Judge(D.A.A.), Lalitpur. The applicant has stated that charge has not been framed in the case as yet. The applicant may place his argument before the trial court at the stage of framing of charge and the trial court shall pass reasoned order if charge has already not been framed.
At this stage, this Court does not see any reason to interfere.
The application is, accordingly, hereby rejected.
