The facts of the case would indicate that the only reason provided by the concerned District Magistrate, through counsel, for not furnishing a certificate to the petitioner under Section 7 of the Transgender Persons (Protection of Rights) Act, 2019 (“Act”) is that the certificate tendered by the petitioner [„Annexure P-4‟], is not in accordance with sub-section 1 of Section 7 of the Act and the Rules made thereunder. It is submitted that the certificate is to be issued by the Medical Superintendent or Chief Medical Officer of the medical institution. 4.

In the facts and circumstances of the case, the Court finds it appropriate to direct the petitioner to approach the concerned Hospital, who in turn, shall issue the certificate by the competent authority i.e., the Medical Superintendent or Chief Medical Officer of that Hospital.
