Judgment
The plaintiffs in O.S.No.51/2014 pending before the Munsiff Court, Adoor have approached this Court seeking the following reliefs:
(i) Issue direction, directing the Hon'ble Munsiff's Court, Adoor to take up I.A.No.333/2016, I.A.No.1289/2017, I.A.No.1310/2018, I.A.No.563/2019
produced as Exhibits P1, P2, P3 and P4 respectively and hear the I.A's and dispose of the same in accordance with law as expeditiously as possible
within a time frame to be fixed by this Hon'ble Court;
(ii) Award to the petitioners the costs of these proceedings;
(iii) Grant such other or further relief as this Hon'ble Court deems fit to grant in the particular facts and circumstances of the case.
But, now it is submitted by the learned counsel for the petitioners that, the petitioners want disposal of I.A.No.333 alone which has been filed in the
year 2016. It appears that the respondents have already filed objection to the said petition.
The learned Munsiff has also expressed her willingness to dispose of all the petitions within a period of one month as per the report dated
12.10.2020. But as the petitioners request right now is only for a direction for early disposal of I.A.No.333/2016, I think that this petition can be
disposed of directing the court below to consider and dispose of that I.A. alone.
Therefore, the learned Munsiff, Adoor shall dispose of I.A.No.333/2016 in O.S.No.51/2014 within a period of one month from the date of receipt of a
copy of this judgment.
This petition is disposed of accordingly.
