Judgment
This petition is filed by the petitioner who was working as a Weigh-man, upon his request for renewal of the licence having been declined by the respondent-authorities.
Learned counsel for the petitioner, furnishes a copy of Order dated 29.04.2025 passed by the Co-ordinate Bench of this Court in Writ Petition in W.P.No.8729/2025 and connected matters and submits that the issue raised in the instant case is addressed in the said matter, directing the respondent-Authorities not to refuse renewal of licence, of persons seeking renewal who have completed age of 60 years. He submits that the petitioner herein is similarly situated as that of the petitioners in aforesaid writ petition in W.P.No.8729/2025 and connected matters and therefore be extended similar relief.
Learned counsel appearing to respondents does not dispute the aforesaid aspect of the matter.
The Co-ordinate Bench of this Court in the said W.P.No.8729/2025 and connected matters has passed the following:
'' ORDER
The petitions are disposed of directing the concerned Market Committees not to refuse renewal of license for the petitioners only because they have completed 60 years of age. The State Government will be at liberty to revisit the entire set of circumstances and arrive at a fresh decision in this regard. "
Therefore, petitioner herein being similarly placed is entitled for similar reliefs. Accordingly, the following:
ORDER
Petition is allowed.
Impugned endorsement dated 09.09.22024 (Annexure-B) issued by the respondent No.3 is hereby quashed.
The respondents are at liberty to reconsider the matter afresh on merits without holding that the petitioner herein has attained the age of 60 years.
