This F.A.O. is preferred challenging order dated 02.09.2022 in I.A. No.1 of 2022 in O.S. No.4 of 2022, as per, which an injunction sought for alleging infringement of trademark was dismissed.
When this matter was taken up for consideration today, learned counsel for the appellant would submit that, this appeal is not pressed on its merits, provided this Court directs disposal of the suit itself within a time frame to be fixed by this Court, untrammeled by any of the observations contained in the impugned order.
This Court called for a report from the learned District Judge, Thrissur as regards the status of Original Suit, O.S. No.4 of 2022. Report dated 22.07.2024 is filed, which seeks three months’ time to dispose of the suit, once the pre-trial steps are completed. Pre-trial steps, if any, shall be taken within two weeks from the date of receipt of a copy of this judgment, whereafter the matter can be listed for trial.
As sought for in the letter of the learned District Judge, three months’ time is granted to dispose of the suit from the date of expiry of the above referred two weeks’ period fixed for pre-trial steps. It is clarified that the suit shall be decided untrammeled by any of the observations contained in the impugned order.
The F.A.O. is disposed of as above.
